Delivery:

Any time or date quoted by cctvaccess.com for despatch is an estimate only. Whilst we will make every endeavour to meet arranged times for delivery, cctvaccess.com shall not be liable to made good any damage or loss, whether arising directly or indirectly, out of any delay in delivery.

cctvaccess.com makes every effort to ensure the availability of all advertised goods. In the unlikely event that any item you have requested is unavailable, we will contact you immediately with an estimate of the expected delivery date.

cctvaccess.com will replace, free of charge, any product damaged or lost in transmit provided you tell us within 7 days of delivery or, in the case of non-delivery, within 7 days of the expected delivery date, that such damage or loss has occurred. In such cases you must inform us by sending an e-mail notification to: info@cctvaccess.com

Refund Policy:

If you decide that you would like to return the product(s) ordered from cctvaccess.com please inform us within 7 days of purchase. We will provide you with a full refund on reciept of the goods provided that the condition of the goods is as new.

Privacy Policy:

cctvaccess.com do not sell your information to any third party for any reason. We do not share your details with any other company and are only required to keep your details for transaction purposes. All information is securely stored protected from unauthorised access and is disposed of when no longer required.

Guarantees:

Goods are covered by manufacturers warranty for 12 months unless otherwise stated, all warranties exclude VCR heads, Monitor tubes & CMOS/CCD sensors damaged by normal wear & tear. The buyer will be responsible for the return and cost of all returns to cctvaccess.com. Goods being returned back to the buyer will be carriage free to UK & Eire addresses only. A copy of the Invoice is required for all warranty claims. Goods returned without an authorisation number will be refused. Goods over 7 days old, or not in as new condition will be subject to a 20% restocking charge and will only be accepted with prior written agreement from the directors of cctvaccess.com. Software does not carry any guarantee and cannot be returned once used. We cannot guarantee that you will be able to connect to your remote CCTV system every time. This is due to various factors such as telephone line condition, net congestion ect.

cctvaccess.com and any of its partners, affiliates and sub companies do not take any responsibility for the performance or operation, financially or physically, of any services developed, supplied or maintained by us. We do not accept liability for any loss or legal proceedings against or encountered by a client (defined as any party to whom cctvaccess.com provide or have provided any products and services to) as a result of their business with cctvaccess.com. The client is solely responsible for the content of any data (video/audio) gained with the use of our services. Customer acknowledges and agrees that cctvaccess.com exercises no control over, and accepts no responsibility for, the content or use of the information gathered with the use of products & serviced provided by us. cctvaccess.com endeavour to provide the best level of service possible although at times cctvaccess.com may be unable to provide a service due to the failure of a third party provider or product without warning. This applies to all products & services provided by cctvaccess.com. All prices are subject to change without prior notice. cctvaccess.com shall have the right, at any time, to pass through and invoice to Customer any new or increased taxes, fees, assessments or other charges imposed on or required to be collected by cctvaccess.com by any governmental agency. Customer shall also be responsible for paying all taxes, fees or assessments and other charges imposed on Customer by any governmental agency that may result from this Agreement, or any of the activities contemplated hereunder. cctvaccess.com reserves the right to modify its products used to provide the Services for purposes including but not limited to accommodating evolving technology & changes in governing laws. cctvaccess.com shall use reasonable efforts to notify Customer of any planned changes to cctvaccess.com's services that may adversely affect the Services provided hereunder. cctvaccess.com do not provide support for individual or business customers unless a maintenance or repair agreement has been made between the client and cctvaccess.com for an agreed price. cctvaccess.com do not provide any support for third party products and services.

Disclaimer of Warranty:

TO THE EXTENT PERMITTED BY APPLICABLE LAW, NEITHER cctvaccess.com, ITS EMPLOYEES, AFFILIATES, AGENTS, SUPPLIERS, THIRD-PARTY INFORMATION PROVIDERS, MERCHANTS, LICENSERS NOR THE LIKE MAKE ANY WARRANTIES OF ANY KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT FOR THE SERVICES OR ANY EQUIPMENT cctvaccess.com PROVIDES. NEITHER cctvaccess.com, ITS EMPLOYEES, AFFILIATES, AGENTS, THIRD-PARTY INFORMATION PROVIDERS, MERCHANTS, LICENSERS OR THE LIKE, WARRANT THAT SERVICES WILL NOT BE INTERRUPTED OR ERROR FREE; NOR DO ANY OF THEM MAKE ANY WARRANTY AS TO THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICES OR AS TO THE ACCURACY, RELIABILITY OR CONTENT OF ANY SERVICES OR MERCHANDISE CONTAINED IN OR PROVIDED THROUGH THE SERVICES. cctvaccess.com IS NOT LIABLE FOR THE CONTENT OR LOSS OF ANY DATA RECORDED OR STORED BY CUSTOMER OR ANY OF CUSTOMER'S CLIENTELE VIA THE SERVICE(S) PROVIDED BY cctvaccess.com.

Indeminification:

Customer will indemnify, save harmless, and defend cctvaccess.com and all directors, officers, employees, and agents of cctvaccess.com (collectively "indemnified parties") from and against any and all claims, damages, losses, liabilities, suits, actions, demands, proceedings (whether legal or administrative) and expenses (including but not limited to reasonable attorneys' fees) arising out of or relating to the use of the Services by Customer, including any violation of the cctvaccess.com Acceptable Use Policy. Such claims shall include, but shall not be limited to, claims based upon trademark, service mark, trade name, copyright and patent infringement, trademark dilution, tortious interference with contract or prospective business relations, unfair competition, defamation or injury to reputation, or other injuries or damage to business.

Limitation Of Liability:

IN NO EVENT SHALL cctvaccess.com BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES, OR LOSS OF PROFITS, REVENUE, DATA OR USE, SUFFERED BY CUSTOMER OR ANY THIRD PARTY, WHETHER IN AN ACTION IN CONTRACT, TORT OR STRICT LIABILITY OR OTHER LEGAL THEORY, EVEN IF cctvaccess.com HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. In no event will cctvaccess.com's liability for any damages, losses and causes of actions whether in contract or tort (including negligence or otherwise) exceed the actual amount paid by Customer for the Service which gave rise to such damages for losses and causes of actions during any period prior to the date the damage or loss occurred or the cause of action arose. Where English law does not allow the exclusion or limitation of warranties or incidental or consequential damages, or the limitation of liability with respect to death or personal injury due to negligence, so that the above limitations or exclusions may not apply to Customer, in such cases.

Force Majeure:

cctvaccess.com shall not be liable for failure or delay in performing its obligations hereunder if such failure or delay is due to circumstances beyond its reasonable control, including, without limitation, acts of any governmental body, war, insurrection, sabotage, embargo, fire, flood, strike or other labor disturbance, breakdown or damage to machinery, equipment or software, malfunctioning of software, corruption of data, interruption of or delay in transportation, unavailability of or interruption or delay in telecommunications or third party services, failure of third party software or inability to obtain raw materials, supplies, or power used in or equipment needed for provision of the Services. In the event of such a Force Majeure, cctvaccess.com shall give the other party prompt written notice within ten (10) days of the Force Majeure. If any such event continues for a continuous period of thirty (30) days, Customer may terminate this Agreement.

Intellectual Property:

Customer represents and warrants that Customer's use of the Services shall not infringe the intellectual property or other proprietary rights of cctvaccess.com or any third party. Customer further acknowledges that all right, title and interest in any and all technology, including software & hardware packages that is part of or provided with the Services and any trademarks or service marks of cctvaccess.com (collectively, "cctvaccess.com Intellectual Property") is vested in cctvaccess.com and/or in cctvaccess.com's licensers. Unless otherwise specifically provided in this Agreement, Customer shall have no right, title, claims or interest in or to the cctvaccess.com Intellectual Property. Customer may not copy, modify or translate the cctvaccess.com Intellectual Property or related documentation, or decompile, disassemble or reverse engineer the cctvaccess.com Intellectual Property, to use it other than in connection with the Services, or grant any other person or entity the right to do so. Unless otherwise specifically provided in this Agreement, Customer is not authorised to distribute or to authorise others to distribute the cctvaccess.com Intellectual Property in any manner without the prior written consent of cctvaccess.com; provided, however, that nothing in this sentence would preclude Customer from using the cctvaccess.com Intellectual Property as incorporated in the Services. This paragraph shall not operate to extinguish, restrict, vary, waive or affect in any manner whatsoever any right, title or interest which Customer may now have or hereafter acquires in, or in relation to, the third-party software that is part of or provided with the Services solely to the extent such third-party licensers. publicly provide such rights, title or interest in the third-party software to Customer.

Equipment:

cctvaccess.com is acting only as a distributor of hardware, software, circuit and equipment (collectively, the "Equipment") offered under this Agreement that was manufactured by a third party. Any malfunction or manufacturer's defects or other defects, outside the control of cctvaccess.com, of Equipment either sold or provided by cctvaccess.com to Customer or purchased directly by Customer used in connection with the Service(s) will not be deemed a breach of cctvaccess.com's obligations under this Agreement. Any rights or remedies Customer may have regarding the performance or compliance of Equipment are limited to those rights extended to Customer by the manufacturer of such Equipment. Customer is entitled to use any Equipment supplied by cctvaccess.com only in connection with Customer permitted use of the Service(s). Customer shall not resell, transfer, export or re-export any Equipment, or any technical data derived therefrom, in violation of any applicable United Kingdom, United States or foreign law.

cctvaccess.com shall not be responsible for any changes in Service(s) outside its control that cause Customer Equipment to become obsolete, require modification or alteration, or otherwise affect the performance of the Service(s). However, if practicable (without an obligation to expend funds or incur additional costs), cctvaccess.com will assist Customer in resolving any such Equipment problems over which cctvaccess.com may have control.
